'Aunt Jemima' Heirs' $3B Royalties Suit Against Pepsi Axed

Law360, Los Angeles (February 18, 2015, 6:26 PM EST) -- An Illinois federal judge on Wednesday tossed a $3 billion royalty suit filed against PepsiCo Inc. and others by the great-grandchildren of the actress who played Aunt Jemima, ruling that the plaintiffs lack standing and do not have the authority to bring the suit.

Anna S. Harrington's great-grandsons Dannez W. Hunter and Larnell Evans Jr. sued Pepsi and subsidiary The Quaker Oats Co. in August 2014 for the use of Harrington's likeness in advertisements and logos, claiming racial discrimination played a role in Quaker's decision not to pay her or her estate a percentage of sales for Aunt Jemima pancake mix...
