Law360, New York (December 5, 2017, 11:36 AM EST) -- During a recent address, Deputy Attorney General Rod Rosenstein announced that the U.S. Department of Justice supports the Yates memo’s emphasis on prosecuting individuals for corporate misconduct. Though the continuation of this Obama administration policy is a criminal law development, the government contracts bar should be attentive to its effect on the debarment system — especially considering that the debarment system concentrates too much on individuals and not enough on what legal theorists call nondistributive corporate misconduct.
