USHealth Dismissed From Cancer Insurance Suit

Law360, New York (March 2, 2010, 2:54 PM EST) -- In a proposed class action over whether insurance companies should pay benefits for cancer treatment procedures, a federal court has dismissed claims against National Foundation Life Insurance Co. parent company USHealth Group Inc. and the director of the South Carolina Department of Insurance.

Judge Joseph F. Anderson Jr. of the U.S. District Court for the District of South Carolina on Thursday dismissed USHealth, but said the plaintiffs could amend their claim asking the court to pierce its corporate veil.
