BIA Upheld 'Illogical' Deportation Ruling, 9th Circ. Says

Law360 (March 29, 2019, 4:52 PM EDT) -- The Board of Immigration Appeals must reconsider whether an immigrant from El Salvador can be granted relief from deportation under the Convention Against Torture, with the Ninth Circuit saying his application was denied based on an "illogical" reasoning.

The BIA had agreed that Juan Castillo’s petition should be denied because the immigration judge didn't find an expert's testimony about the dangers in El Salvador to be reliable. But the Ninth Circuit said that expert — presumably government consultant and gang expert Thomas Boerman — should have been given more credit. The ruling identifies him only by last name.
