Geico Claims Fraud By Plaintiff Seeking Fla. Class Action

Law360, Miami (June 13, 2017, 8:52 PM EDT) -- Geico General Insurance Co. looked to shatter a Florida auto glass repair shop's effort to lead a class action claiming the insurer routinely underpays for windshield replacements, alleging Tuesday that the shop made false statements to assert standing in the case.

VIP Auto Glass Inc. claims that the insurer's approved prices for reimbursement "have absolutely nothing to do" with the amount most shops actually charge and that, by leaving policyholders to pay the balance, the practice results in what are essentially deductibles, which Florida state law does not permit for windshield replacements.
