Dallas Lab Calls UnitedHealth's $100M Fraud Suit 'Shakedown'

Law360, Houston (October 5, 2017, 2:57 PM EDT) -- Dallas-based Next Health LLC hit back on Wednesday against a $100 million fraud lawsuit UnitedHealthcare Insurance Co. lobbed against it in January, bringing counterclaims for violations of the Employee Retirement Income Security Act and accusing the insurer of underpaying valid claims and “corporate bullying.”

Calling the January lawsuit a “shakedown,” Next Health, which was sued alongside several of its subsidiaries that perform drug and genetic laboratory testing, told the court United Healthcare is attempting to use this litigation as a vehicle to force small, out-of-network laboratory...
