Ill. Court Affirms Insurer Cap On Parts Co. Asbestos Claims

Law360, New York (December 6, 2017, 4:22 PM EST) -- The Illinois Appellate Court Tuesday found a conveyor belt maker’s use of asbestos parts in its products constitutes a single decadeslong occurrence for the purposes of its Travelers’ Indemnity Co. insurance policy.

The three-judge panel upheld a lower court ruling rejecting United Conveyor Corp.’s argument that each conveyor installation was a separate occurrence for the purposes of its policy limits and accepting Travelers’ claim it only owed the lower limits for a single continuous occurrence.
