Fed. Circ. Told Patent Act Applies To US Ships Overseas

Law360, Washington (January 11, 2017, 3:06 PM EST) -- M-I Drilling Fluids UK Ltd. urged a Federal Circuit panel Wednesday to rescue a patent suit against a company that allegedly infringed M-I oil drilling patents while off the coast of Brazil, insisting that the Patent Act applies to U.S.-flagged ships.

U.S. District Judge Ann D. Montgomery had dismissed M-I’s claims against Dynamic Air Ltda. on the grounds that the Brazilian industrial supplier merely acted in response to its client Petroleo Brasileiro SA, better known as Petrobras, when installing the allegedly infringing equipment on U.S. vessels....
