Despite Drop In AIA Reviews, PTAB Hasn't Lost Its Luster

Law360 (January 31, 2019, 10:03 PM EST) -- The number of petitions for America Invents Act review fell to a four-year low in 2018, a drop attorneys say may be less about changes taking place at the Patent Trial and Appeal Board and more about external factors, including the continuing decline in infringement litigation.

There were 1,718 petitions filed challenging the validity of patents in AIA review, down 4 percent from 2017, according to a new year-in-review report from Lex Machina. The volume of filings — the lowest since 2014 — continues a downward trend that began in the early part of 2017.
