Fed. Circ. Upholds Ax Of Densify's $236M Patent Verdict
By Andrew Karpan (September 22, 2021, 7:32 PM EDT) -- The Federal Circuit on Wednesday rejected a bid by cloud infrastructure company Densify to revive a jury's $236 million patent infringement verdict against VMware, siding with the lower court that Densify lacked standing to sue.
A three-judge panel shot down the mandamus petition lodged by Cirba Inc. — a cloud infrastructure company that does business as Densify which hoped for a rethink on a ruling from U.S. District Judge Leonard P. Stark late last year that found the language of a corporate licensing agreement only allowed Densify's patent licensing business, Cirba IP Inc., to level infringement claims against VMware.
