East Texas Patent Docket Could Be Grounded By Fed. Circ.

Law360, New York (March 9, 2016, 4:16 PM EST) -- The Federal Circuit will hear arguments Friday in a case that could dramatically reshape patent litigation by setting venue rules that would effectively bar most suits from the Eastern District of Texas, where nearly half of all patent complaints were filed last year.

The appeals court will consider a mandamus petition filed by liquid sweetener company TC Heartland LLC, which is urging the court to cast aside a 1990 holding that patent suits can be filed in any district where the defendant makes sales.
