Samsung Can't Fight Treble Damages, Patent Co. Says

Law360, New York (January 6, 2017, 8:59 PM EST) -- A Texas federal court has no reason to disturb an enhanced-damages award against Samsung Electronic Co. Ltd., an intellectual property firm claimed Friday, saying a jury’s roughly $7 million verdict against Samsung was rightly multiplied to $20.7 million for knowingly infringing two imaging patents.

Imperium IP Holdings Ltd. contended in its response to Samsung's motion for reconsideration of the damages that a December Patent Trial and Appeal Board ruling invalidating one of the challenged patents in favor of the smartphone giant does not make Samsung’s defenses “objectively reasonable,” nor does it imply the enhancement should be called off.
