Fla. Swingers Club Can’t Duck Models’ Trademark Suit

Law360, New York (July 14, 2017, 7:51 PM EDT) -- Creating the impression that famous models have endorsed a swingers club when in fact their photos were used without their permission could violate state business and federal trademark laws if true, a Florida federal judge said Friday.

U.S. District Judge Virginia M. Hernandez Covington denied Tampa-based club Eyz Wide Shut and operators Andrew and Susan Harrow’s motion to dismiss the would-be collective action brought by Amber Lancaster, a current model on the game show “The Price is Right.”
