Pharmacies' Surescripts Antitrust Case Survives Dismissal

By Matthew Perlman (June 22, 2022, 6:29 PM EDT) -- An Illinois federal court has said pharmacies may move forward with their revamped suit accusing Surescripts of monopolizing the e-prescribing market through the use of restrictive loyalty payments and deals with other industry players including Allscripts.

On Tuesday, U.S. District Judge John J. Tharp Jr. denied bids from Surescripts LLC and Allscripts Healthcare Solutions Inc. to dismiss an amended complaint brought by a proposed class of pharmacies looking to recover overcharges they allegedly paid as a result of the anti-competitive activity.
