9th Circ. Won't Restart Copyright Suit Over 'The Unborn'

By Bill Donahue (February 20, 2014, 7:11 PM EST) -- The Ninth Circuit said on Thursday it wouldn't rehear an appeal from an author who claims that Relativity Media LLC unit Rogue Pictures ripped off the plot for the 2009 horror film "The Unborn" from his unfilmed script.

In a brief order, the appeals court denied Daniel Segal's request for en banc or panel rehearing, after he'd argued that the three-judge panel ran afoul of U.S. Supreme Court precedent by performing an insufficient, cursory analysis on substantial similarity when it refused to revive his case in November.
