Law360, New York (July 10, 2015, 2:36 PM EDT) -- On July 8, in a thorough and well-reasoned 70-page decision on cross-motions for summary judgment, Judge Gerald Bruce Lee of the Eastern District of Virginia affirmed cancellation of six registrations for "Redskins" marks owned by the Washington Redskins football team on the ground that the marks are disparaging to Native Americans. Judge Lee rejected all of the Washington Redskins' arguments about why their trademark registrations should not be canceled, and agreed with all of the arguments of the Native Americans who had successfully petitioned to cancel those registrations in the Trademark Trial and Appeal Board, as well as the arguments of the U.S. government, which had intervened on the Native Americans' side with regard to the Redskins' arguments that Section 2(a) of the Lanham Act is unconstitutional....
