Proxy Marriage, Stepson Can Keep Immigrant In US: 3rd Circ.

Law360 (August 9, 2018, 6:14 PM EDT) -- An undocumented Ecuadorean immigrant can claim his American-born stepchild as a reason to stay in the U.S. even though he was officially married to the boy’s mother in a proxy ceremony when the bride and groom were in separate countries, the Third Circuit ruled Wednesday.

The appeals court said that Ecuador’s laws recognized Luis Antonio Jimenez Villa’s May 2015 marriage, officially making his wife’s son from a previous relationship, Kevin, his stepson and allowing him to argue his deportation would create a hardship for the child....
