3rd Circ. Voids Immigrant's 12-Month Sentence For Re-Entry

Law360, Philadelphia (January 10, 2017, 2:14 PM EST) -- The Third Circuit on Monday issued a precedential decision vacating a Dominican man’s 12-month prison term for illegal re-entry into the United States after finding that a trial judge had misrepresented the offender’s arrest record.

The appeals court said that a sentencing judge in the re-entry case had imposed the prison term based, in part, on arrests in which charges against the man were ultimately withdrawn or dismissed.
