McKesson Beats Class Cert. Bid In TCPA Ad Fax Suit

By Melissa Daniels (August 22, 2016, 8:15 PM EDT) -- A California federal judge on Monday shot down a class certification bid from a chiropractic clinic accusing McKesson Corp. of faxing unsolicited advertisements in violation of the Telephone Consumer Protection Act, saying there are too many individual circumstances to tackle on a classwide basis.

True Health Chiropractic and McLaughlin Chiropractic Associates accused health care services company McKesson of sending faxed advertisements without approval, and sought class certification in July 2015 for all other recipients of the offers.
