Eddie Bauer Wants Credit Union's Data Breach Suit Nixed
Law360, New York (April 28, 2017, 2:42 PM EDT) -- Eddie Bauer urged a Washington federal judge Thursday to toss a proposed class action claiming financial institutions have had to pick up the pieces after a 2016 data breach, saying Iowa law applies because the credit union leading the suit is based there and the allegations don’t pass muster under that state's laws.
Veridian Credit Union doesn’t allege sufficient facts to support negligence and other allegations against Eddie Bauer LLC, the Washington-based retailer argued, contending that the credit union’s efforts to take advantage of Washington’s more favorable laws don’t save the deficient claims.
