Insurer Wants No Part Of Four Loko Suits

Law360, New York (May 20, 2011, 3:37 PM EDT) -- A Selective Insurance Group Inc. subsidiary filed suit Thursday in Illinois in an effort to avoid covering the maker of the caffeinated alcoholic drink Four Loko from lawsuits and class actions alleging wrongful death, product liability and trade dress infringement.

Selective Insurance Co. of South Carolina, which issued a combined general liability/umbrella policy of insurance to Four Loko maker Phusion Projects LLC, says in its complaint that it was not obligated to defend or indemnify the company from three proposed class actions and five other suits, along with one notice of claim for monetary damages and another threatened suit.
