Roche Says NJ Judge Biased In Accutane Mass Tort Litigation

By Linda Chiem (December 12, 2012, 5:20 PM EST) -- Pharmaceuticals giant Hoffmann-La Roche Inc. on Tuesday sought to have New Jersey Superior Court Judge Carol Higbee removed from all cases in mass tort litigation over its acne drug Accutane, accusing the judge of bias in a docket she has presided over for nearly a decade.

Roche contends that Judge Higbee has made biased public statements, prevented critical scientific evidence favorable to Roche from being presented in court, openly criticized Roche and its attorneys and ignored binding legal precedent, according to a 47-page memorandum of law in support of its motion to recuse filed in Atlantic County.
