Pfizer Faces Whistleblower Suit Over Lipitor Marketing

Law360, San Francisco (January 13, 2014, 6:30 PM EST) -- Health Support Awareness Inc. hit Pfizer Inc. with a whistleblower suit accusing the pharmaceutical giant of misbranding and promoting its statin, Lipitor, in deceptive ways that led customers to defraud Medicare, Medicaid and others, according to a lawsuit unsealed in Massachusetts federal court Friday.

Pfizer's campaign to keep the drug in demand and its price high cheated the government of billions of dollars, Health Support Awareness claims. Between 2007 and 2010 alone, 43 percent of Medicare patients were on some form of statin, which cost the government-run health program $6.7 billion in 2010 alone, the complaint said.
