9th Circ. To Reconsider Its Remand Of Teva Painkiller Suit

Law360, New York (February 11, 2014, 7:38 PM EST) -- The Ninth Circuit on Monday agreed to take another look at its remand to state court of a lawsuit against Teva Pharmaceuticals Inc. that's part of a mass action over cardiovascular injuries allegedly tied to propoxyphene painkillers after the drugmaker argued that the decision created a troubling circuit split.

In a brief order, the appeals court said the case will be reheard before all of its judges, adding that a three-judge panel's September decision upholding a lower court's remand order should not be cited as precedent within the circuit.
