Cook Medical's 2nd Bellwether Pick OK'd In Vein Filter MDL

By Shayna Posses (October 17, 2016, 8:11 PM EDT) -- An Indiana federal judge on Monday selected Cook Medical Inc.'s pick for the second bellwether trial in multidistrict litigation brought by patients alleging they were injured by the company's vein filters, holding that the suit is more representative of the injuries and issues alleged than the other option.

The patients argued that Gage v. Cook Medical Inc. was too similar to the first bellwether selection slated for October 2017, Hill v. Cook Medical Inc., which the company also picked, but Chief U.S. District Judge Richard L. Young concluded that the suit is a better representation of the claims than the plaintiffs'...
