Navistar Buyers Say Ill. Claims Should Go First In MDL

Law360, New York (August 11, 2017, 7:52 PM EDT) -- Truck buyers in multidistrict litigation alleging truck and bus manufacturer Navistar Inc. knowingly sold vehicles with defective diesel engines asked an Illinois federal judge on Thursday to order that claims for Illinois buyers should go first.

The truck buyers asked Judge Joan B. Gottschall to adopt a bellwether-class procedure for the litigation; specifically, they’re asked that the judge order the parties litigate class certification, summary judgment and Daubert motions — and hold a trial — first for Illinois plaintiffs.

This would preserve resources for the court...
