Ga. Partnership Fights $8.6M Tax Donation Denial By IRS

Law360 (March 8, 2018, 7:47 PM EST) -- A Georgia partnership is asking the U.S. Tax Court to allow an $8.6 million deduction for donating a land conservation easement over 411 acres, claiming the IRS denied the deduction without reason.

The partnership, Dasher’s Bay at Effingham LLC, donated the conservation easement in Georgia in 2010 only to get a final partnership administrative adjustment in November 2017 that said it failed to meet the requirements of Internal Revenue Code § 170.
