Pa. Developer's Defamation Suit Against Enviros Stays Nixed

By Matt Fair (September 7, 2018, 5:02 PM EDT) -- A Pennsylvania appeals court has declined to revive a suit against an environmental group claiming that it defamed a developer and interfered with the developer's business prospects as the group lobbied against a planned cluster of new townhomes on a contaminated former industrial site in suburban Philadelphia.

A state Superior Court panel agreed on Thursday that the Delaware Riverkeeper Network was entitled to protection from O'Neill Properties Group LP's lawsuit based on the so-called Noerr-Pennington doctrine, which immunizes entities from liability for exercising their First Amendment right to petition the government.
