8th Circ. Axes Part Of Minn. Athletes' Win In Title IX Case

By Max Jaeger (October 28, 2021, 7:29 PM EDT) -- A Minnesota federal judge took on the role of de facto "super-athletic department director" when he erroneously ordered a state university to exceed its Title IX obligations, an Eighth Circuit majority found Thursday, even as it agreed with female former athletes that the school ran afoul of the sex bias law.

The split decision affirmed U.S. District Judge John R. Tunheim's conclusion that St. Cloud State University violated Title IX by not providing equitable participation opportunities for men and women, and that it organized sports teams into three tiers, then allotted them different levels of financial support.
