Apple Again Ducks False Ad Suit Over Storage Capacity

Law360 (November 7, 2018, 2:47 PM EST) -- A California federal judge has once again dismissed a lawsuit alleging Apple Inc. falsely advertised the storage capacity of its iPhones, iPads and iPods, saying the proposed class of consumers failed to state its case for how it was misled.

U.S. District Court Judge Edward J. Davila on Tuesday wrote that the second amended complaint submitted by the class, led by Paul Orshan, Christopher Endara and David Henderson, didn’t address the lack of specificity that caused the previous complaint to be dismissed.
