Judge Shuts Down IMac Display Screen Class Action

Law360, New York (December 21, 2009, 5:41 PM EST) -- A federal judge has dismissed a proposed class action alleging Apple Inc. failed to disclose a manufacturing defect in iMac display screens, largely ruling that the plaintiff had failed to adequately plead his case and giving him only limited opportunities to make additional changes.

Judge Jeremy Fogel of the U.S. District Court for the Northern District of California granted Apple’s motion to dismiss Thursday, saying the plaintiff could only amend a common-law claim that Apple had a duty to disclose the alleged defect to its customers...
