Beyonce Still Can't Nix Video Game Suit, Appeals Court Says

Law360, New York (November 8, 2012, 7:32 PM EST) -- A New York intermediate appeals court on Thursday affirmed a lower court ruling that pop singer Beyonce could not nix a suit alleging she violated a contract by abruptly pulling the plug on a multimillion-dollar video game development deal.

The five-judge panel said the lower court correctly denied Beyonce's motion for summary judgment to dismiss the complaint brought by Gate Five LLC accusing the pop singer of abandoning the project, "Starpower: Beyonce," which the game developer was creating for Microsoft Corp.'s Xbox Kinect system. The panel said issues of facts remained, allowing Gate Five's suit to survive, according to the order....
