Soverain Ruling Threatens Patent System, High Court Told

Law360, Washington (November 20, 2013, 3:02 PM EST) -- Structured content developer i4i Inc. urged the U.S. Supreme Court on Monday to reverse a Federal Circuit decision invalidating a Soverain Software LLC e-commerce patent asserted against Newegg Inc., claiming the appellate court has undermined the entire patent system.

In its amicus brief to the high court, i4i claimed the Federal Circuit's ruling "eviscerates" the clear and convincing standard courts use to consider patent invalidity in favor of de novo review by the appellate court, which adds unnecessary uncertainty to the litigation process.
