2 More SEC Whistleblower Actions And Lessons Learned

Matthew T. Martens Continuing its efforts to bring enforcement actions for violations of whistleblower protections, the U.S. Securities and Exchange Commission recently settled two more cases. Both cases involved severance agreements that contained provisions that, the SEC asserted, expressly prohibited former employees from communicating with the government about possible violations of law. One of the cases also represented the SEC's first case involving retaliation for internal whistleblower reporting, as opposed to retaliation for reporting to the SEC. These cases demonstrate again...
