Invalidation Of DOL Overtime Rule Leaves Employers In Limbo

By Charles Feuss (September 5, 2017, 10:40 AM EDT) -- Just in time for Labor Day, Judge Amos Mazzant of the U.S. District Court for the Eastern District of Texas issued an opinion and order on Aug. 31, 2017, which invalidates a controversial overtime rule published by the U.S. Department of Labor on May 23, 2016.[1] That rule would have increased the salary requirement for the so-called "EAP" or "white collar" exemptions for executive, administrative and professional employees under the Fair Labor Standards Act from $455 per week to $913 per week, thereby excluding approximately 4.2 million currently exempt salaried workers from the exemptions. This significant change was promoted by the Obama administration as a means of raising the incomes of many low- to middle-income Americans while "modernizing and streamlining" the overtime rule....
