$9M Severed Leg Suit Against NJ Agencies Revived

Law360, New York (December 6, 2017, 8:12 PM EST) -- A New Jersey appeals court on Wednesday reversed a lower court’s finding that state agencies could not be held liable for their response to a 2005 multi-car pileup that cost a woman her leg, ruling that they had waived their right to argue immunity from a $9 million judgment.

The three-judge panel said in a published opinion that the trial court judge had misapplied the appellate division’s 2015 decision in Royster v. New Jersey State Police, which held that the doctrine of state sovereign immunity bars...
