Feds To Pursue Retrial Of 4 Corporate Advisers In Fraud Case

Law360, Boston (March 21, 2018, 8:43 PM EDT) -- Federal prosecutors have signaled they intend to retry a group of former Georgeson LLC advisers after a mistrial was declared when a juror left the fraud case and one defendant balked at a proceeding with a short-handed panel, a Massachusetts federal judge said Wednesday.

Three former managers at the leading proxy solicitation firm — Michael Sedlak, Richard Gottcent and Charles Garske — had agreed to wrap up the trial despite a juror’s dismissal the day before closing arguments after three weeks of testimony. Their co-defendant, Donna Ackerly, who lost a bid to sever her case before trial, disagreed.
