'Why Are You Here?' 2nd Circ. Asks Convicted Former Lawyer

Law360, New York (June 16, 2017, 5:25 PM EDT) -- The Second Circuit expressed deep doubt Friday with a disbarred lawyer who is seeking a writ dissolving his nearly 12-year-old fraud conviction, with two judges bluntly suggesting that his pro bono counsel had no business before them.

Convicted fraudster Eric A. Klein's bid for a writ of coram nobis voiding his conviction got off to a rough start when Judge Denny Chin admonished his pro bono appellate counsel, Howard D. Simmons, for being late.
