ORDER: On May 29, 2026, Plaintiffs' counsel filed a motion for attorneys' fees and costs "pursuant to [Section] E.2 of the Stipulation, Order, and Consent Judgment on Plaintiffs Class Claims[.]" (ECF No. 422.) On June 26, 2026, Defendants filed an opposition memorandum making various arguments regarding why the fees and costs sought were not within the scope of Section E.2. (ECF No. 429-1 at 1-12.) On July 10, 2026, Plaintiffs' counsel filed a reply memorandum stating that they made an "obvious mistake" in not referring to Section E.1, and only referring to Section E.2, and that they are entitled to fees and costs under both Sections E.1 and E.2. (ECF No. 434 at 4-5.) Defendants have not yet briefed the issue regarding what fees and costs are due to Plaintiff's counsel under Section E.1. Accordingly, no later than July 28, 2026, Defendants shall file a sur-reply memorandum addressing the fees and costs due to Plaintiffs' counsel under Section E.1. Prior to the submission of the sur-reply, the parties are directed to meet and confer in order to seek "resolution on the matter," as contemplated by Section E of the Stipulation and Order (ECF No. 410 at 8-9).
