Enviros Ask 9th Circ. Not To Dismiss Keystone XL Challenge

Law360 (April 24, 2019, 6:05 PM EDT) -- Environmental groups said President Donald Trump’s move to issue a new permit for the Keystone XL pipeline does not mean that the Ninth Circuit should dismiss the case and throw out a lower court’s order enjoining construction.

The Northern Plains Resource Council and other groups said the quality of the environmental review for the project is what is at issue in the litigation. That concern is not moot just because Trump signed a new permit for the pipeline allegedly to circumvent cumbersome litigation and allow construction to begin, the opposition brief said.
