Title Insurance Cos. Beat Kickback Suit At 2nd Circ.

Law360, New York (July 3, 2012, 6:06 PM EDT) -- The Second Circuit on Tuesday upheld the dismissal of a putative class action accusing Fidelity National Title Insurance Co. and other title insurers of taking kickbacks, saying the plaintiffs had no concrete allegations.

Several suits have accused the industry of driving up prices for title insurance — which covers property buyers against the possibility of competing claims on their properties because of poor public title records or other problems — beyond what they should be.
