Aereo Ruling Dooms Dish's 'Hopper,' Fox Tells 9th Circ.

By Michael Lipkin (June 27, 2014, 6:02 PM EDT) -- Fox Broadcasting Co. has told the Ninth Circuit that the U.S. Supreme Court's blockbuster Aereo Inc. decision bolsters its infringement case against Dish Network Corp. over the place-shifting features in Dish's Hopper DVR, arguing that Dish's video streaming features are nearly identical to Aereo's.

Fox wrote in a Wednesday letter to the Ninth Circuit that the Aereo decision, finding that the online streaming television service violated copyright law by transmitting broadcast programming without permission, was directly relevant to its Dish appeal.
