US Doesn't Owe ACA Money To Insurers, Fed. Circ. Rules
Law360 (June 14, 2018, 11:11 AM EDT) -- Health insurance companies are not entitled to billions of dollars in Affordable Care Act funding that Congress has withheld, the Federal Circuit ruled Thursday.
In two highly anticipated decisions, the Federal Circuit said that Congress has lawfully withheld funding for the ACA's so-called risk corridor program, which was intended to lessen financial losses for insurers during the ACA's first few years.
The decisions specifically apply to cases brought by health insurers Moda Health Plan Inc. and Land of Lincoln Mutual Health, but they will likely affect all other cases involving the same issue. The decisions resolve a split in the lower...
