Coca-Cola Cleared From Diet Coke False Ad Suit

Law360 (February 27, 2018, 8:06 PM EST) -- A California federal judge Tuesday granted The Coca-Cola Co.'s motion to dismiss a false advertising class action that claims Diet Coke actually causes weight gain, but said that plaintiffs could retry if they brought stronger arguments supported by scientific evidence.

Though he did give permission to amend and try again, U.S. District Judge William Alsup said that the 13 studies cited to show that there is weight gain linked to aspartame, the sweetener in Diet Coke, weren't enough right now.
