NY Judge Again Denies Papa John's Drivers Class Cert.

By Kat Greene (March 1, 2018, 8:15 PM EST) -- Papa John's drivers lost a second attempt at class certification in their suit accusing the pizza chain of underpaying them in violation of the Fair Labor Standards Act when a New York federal judge ruled Thursday they hadn't shown the underpayment was part of a companywide policy.

The proposed class of drivers had taken a second stab at conditional certification in May, but U.S. District Judge Cathy Seibel refused to grant it after concluding the workers hadn't shown the alleged underpayments were directly tied to Papa John's International Inc., according to a defense lawyer at the hearing.
