NCAA 'Markdown Madness' Suit Is 'Do-Over,' Car Co. Says

Law360 (March 5, 2018, 6:12 PM EST) -- A California car dealership is pushing a federal judge to toss a lawsuit filed by the National Collegiate Athletic Association over “Markdown Madness” advertisements, calling the case a “do-over” of an earlier dispute at the trademark office.

Ken Grody Management Inc., which owns two Ford dealerships near Los Angeles, said Sunday in its motion to dismiss that the NCAA’s new infringement lawsuit is an improper attempt to “usurp” a years-old case at the Trademark Trial and Appeal Board that’s nearly set for a final ruling....
