NJ Hooters Must Arbitrate With Insurer Over Fatal Crash

Law360 (March 13, 2018, 1:32 PM EDT) -- A Hooters restaurant located in an Atlantic City, New Jersey, casino hotel must arbitrate an insurer's claims for reimbursement of the benefits it paid in connection with a fatal car crash that was allegedly caused by a drunk patron, a state appeals court said Tuesday.

The appellate panel affirmed a trial court's order granting 21st Century Pinnacle Insurance Co.'s motion to compel arbitration of the company's claims against A.C. Wings LLC and its insurer, Allied World Assurance Co., finding that the Hooters restaurant is a “tortfeasor”...
