Title Insurance Class Action Needs Repleading: Judge

Law360 (May 21, 2009, 12:00 AM EDT) -- Citing Twombly, a federal court has dismissed consolidated class action allegations of price-fixing in the California title insurance industry but has granted plaintiffs the chance to amend their complaint to better support the sweeping accusations.

Judge Jeffrey S. White of the U.S. District Court for the Northern District of California ruled that plaintiffs failed to substantiate allegations that the dominant title insurance providers impose supracompetitive prices and set rates based on commissions and kickbacks.
