Centocor Patents Stand In Fight Over Abbott's Humira

Law360 (May 27, 2009, 12:00 AM EDT) -- A federal judge has refused Abbott Laboratories' bid to invalidate two patents in an infringement suit brought by Centocor Inc. and New York University over Abbott's flagship arthritis drug Humira.

Judge T. John Ward of the U.S. District Court for the Eastern District of Texas on Wednesday denied the drugmaker's motion for summary judgment, ruling that questions of anticipation that could invalidate that patents are matters of fact, not law.
