7th Circ. Nixes Suit Over NHL Player's Death

Law360 (May 25, 2018, 9:01 PM EDT) -- A Seventh Circuit panel Friday affirmed the dismissal of a wrongful death lawsuit the parents of deceased ice hockey player Derek Boogaard brought against the NHL, finding the lower court rightly tossed the suit after the family did not respond to one of the NHL's arguments.

The three-judge panel unanimously agreed that Len and Joanne Boogaard had sealed their fate when they did not respond to the National Hockey League's argument that the parents failed to state a claim. Even in this appeal, in what the panel called a "curious situation," the Boogaards' spent almost their entire brief attacking another ground...
